First thing's first, I am willing to pay for the 3.0 upgrade. The thing is: I just bought my touch a week ago and then I jailbroke it using quickfreedom; I remember downloading a 2.2.1 os even if I already had it in my touch. I'm not that well-informed in the jailbreaking algorithm, so I'm just wondering if it ten bucks would just go into waste when the jailbreak program would require me to download a modified one (idk). I didn't try to understand the process thoroughly 'coz I just followed the instructions

if you pay to update to 3.0 and then want to jailbreak it you do not have to fork out more money it will use the excisting 3.0 firmware file you have paid for

Of course you need to pay, it has nothing to do with the jailbreak.
And even if you could, that would be illegal!

You need to pay for the 3.0 firmware update from Apple
Not the jailbreak.....

That step is only required if you dont already have it.

That is actually not true. You must download the firmware because quickpwn pulls some files from it and it is illegal to distribute just those files. This is why you must download firmware to jailbreak.

I've got the same question as dualBang did a while ago. He's one of my beta testers and of course I'm on my Dev account, will we have to pay for it?
As for an on topic response. Yes, you'll have to pay, as others have said. In order to jailbreak, you need to obtain a 3.0 ipsw. I'm sure there are ways to obtain the ipsw without paying, however, the right, legal, way to do it would be to shell out the $10. All that jailbreaking does is modify the ipsw that you already have and save it as a different ipsw, it doesn't actually download any illegal Apple files. That's why it is legal. If it worked by downloading the prepatched ipsw from a 3rd party, it'd be illegal.
EDIT: Forget my first question, I found a response here (http://www.ipodtouchfans.com/forums/showthread.php?t=182129).

When the firmware is released you could get it for free and dfu restore it, but that would be illegal.

good idea espicially if u have a warenty. if your a dev you dont have to pay for it. also if you dont have a ipsw on your computer sync your ipod with your computer and it will make a exact backup of the ipsw you have on your ipod.
